ncp/audley end station car park,,nr, cambridge.

hi guys,a cyber friend of mine has recieved a ,,,parking contravention charge notice from these clowns for £75-00 for non display of ticket,she had one, but displayed the incorrect slip,,,anyway i get confused about the laws of railway station parking,just need clarification please,,,its payable to ncp and she has been threatened with a nationwide ban from all their car parks??? from what she has told me it does NOT quote any contravention of laws etc etc,,,please advise if this is safe to ignore,,many thanks.

    Ignore them . How the hell are they going to give a nationwide ban is beyond me, do they have images of what your friend looks like ? Do they realise that it could be more than 1 person driving a car ? Or that car could have been sold to somebody else ?

    Yes they own the land but I seriously doubt they would risk another hiding in court on this, the last time they did so and included towing the vehicle away it cost them a fortune, their legal costs probably will top £50k . And as towing is now illegal on private land how without going to court are they to enforce this ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    The driver paid the landowner for the use of their land. As long as the tickets make no mention of railway bye-laws (unlikely as it will probably be owned by NCP).

    They can ban the driver from all NCP car-parks, but not the vehicle. Just ignore them

    Yep, your friend is safe to ignore this, but of course if it was me I would appeal to NCP then POPLA wuith her evidence. I'd do this, in her shoes, because it will cost NCP money, is a reasonable response if ever NCP thought they'd chance Small Claims Court (almost unheard of) and because it will save her the hassle of the letters because she should win at POPLA (doesn't matter if she doesn't as she can revert to ignore mode of course). NCP would not ban a vehicle from a car park for one PCCN that's appealed and shows evidence of payment - we have seen them try though, they just put a piece of A4 paper on the car (big deal, and only for lots of ignored tickets). There was a case on pepipoo which cost them a lot of money in the end, but that involved lots of ignored tickets - loads! - and a towing away before the ban. Not relevant here and now!

    A 'PCCN' from NCP does not equate to a penalty that can end up in Mags Court. The only ones to take really seriously in Railway car parks are actual Penalty Notices issued by the Train Operator themselves, like Northern Rail do sometimes.
