Hi there.
I was looking for a bit of advice.
Basically, I placed an order with The Hut last month. It turns out that it was a mis-price, for £4.99 (should have been £144.99)
They tried to cancel the order right away, but I got an email saying 'order can not be canceled as it is awaiting dispatch' They then took the money from my bank account.
On the 13th of December I got an email saying the goods have been dispatched. 10 minutes later I had an email saying I had been fully refunded
The tracking info says 'order generated' and that's it. So it seems that they've ordered the parcel delivery, to make it look to me that it's been dispatched, but never actually sent the parcel to MyHermes.
I've been guaranteed, numerous times, that it has been dispatched, but it clears hasn't, so they've lied to me.
I was just wondering if there was anything I can do to get the goods?
Thanks.

To a company who lie about dispatching goods? No thanks.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Who guaranteed you?
Most online companies have their T&Cs set so no contract is formed until they physically dispatch the goods. If they havent dispatched them, there is potentially no contract meaning you cannot force them to fulfil the order at the lower price. You keep using that word. The customer service team guaranteed me. I have about about 5 emails/messages from them assuring me that it had been dispatched.
Cheers.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
The T&Cs are:
Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit, debit card or PayPal account or (ii) dispatch the goods to you or commence the services, whichever is the later.Hi, we’ve had to remove your signature. You say you had an email saying you had been refunded. Have you got the money back?
I mean really, did you think you were going to get something that should have been £150 for a fiver!!!0 -

You seem confused - you don't want to deal with the company as they have told you lies, yet you do want to receive the goods. You can't have it both ways!0 -

When they took my money and sent me a dispatch email, yes, I did think that I was going to get something that should have been £150, for a fiver.Hi, we’ve had to remove your signature. Nope. Not confused. I simply want them to fulfil the contract I entered in to with them.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
OP, can you clear something up as your initial post is confusing.
Have you actually paid anything and if so how much?
Have you been refunded in full?0
