Barclaycard PPI T&Cs

I have repeadily asked Barclaycard for T&Cs for PPI in 1997 and they have acknowledged my request but not sent them!

Anybody know if PPI applied to an account in 1997 covered unemployment? Barclaycard say it did not cover unemployment

    How did you request them, through a SAR or Section 78, and how long ago did you ask for them?
  • I made a S78 request, the 1st time i requested them 12 months ago and then twice since then.

    I was thinking about sending another letter giving 14days and then if no joy make a complaint to the ICO? Or just go staright to the ICO?

    is the account still open? S78 requests only apply to open accounts or where there is a debt. A nil balance account or closed account cannot use S78.

    The ICO has no remit over the consumer credit act and the provider has not breached the data protection act. If you had done a DSAR instead of a S78 request then you could go to the ICO. However, you havent yet.

  • Barclaycard declined my claim for PPI, my claim was based on the fact that i was on out of work benefits at the time the ppi was taken out.

    BC rejected the claim stating that the PPI Policy did not cover "involuntary unemployment" - I am trying to obtain details of the policy T&Cs that state this.

    Is a SARs request the best way to go about this?

    You can't request T&Cs for accounts which are closed. You've been making an invalid request of them, so your only complaint can be that they didn't reply in the negative.

    This sounds like the opposite of what should be. A PPI policy should ONLY payout in the event of involuntary unemployment. It won't payout if you made yourself unemployed by resigning or being sacked etc.

    Have you mis-read their reason for declining your complaint?

    You do realise that you only have six months from the date of their original rejection to refer your complaint to FOS?
    If your complaint was more than twelve months ago then you may as well forget it.
