No logbook after six months. Car still registered to trade
Hi there,
Just after some advice on what to do next. I have been chasing Glyn Hopkin Honda now for about three months, as I have not received the logbook for a car I purchased back in July 2012. When I spoke to the DVLA they told me that the car was still registered to trade, and it would take a five minute phonecall from Glyn Hopkin to sort out.
I have since spoken to Glyn Hopkin on multiple occasions, and they keep promising to sort this out, but they never do. Admittedly I made the foolish mistake of leaving the showroom without the green slip from the logbook, a mistake that is purely my own, but surely they still have some liability.
Basically I have a couple of questions (well three
)
1) Where do I stand legally driving a car that is not registered to me, does it invalidate my insurance?
2) Do I have any legal rights with Glyn Hopkin, ie to make them sort it, or do they have me over a barrel.
3) Is there any way I can sort this myself without their help. As mentioned above I don't have the green slip from the old logbook, but is there anyway around this.

I don't know all the answers, but on point 1, check your insurance documents. If it says something like "You/your spouse/civil partner is the registered keeper", then you could get into trouble if you try to claim.
Don't know the legal position, but it sounds like the dealer no longer has the green slip or even the V5C document. You presumably have some sort of invoice as proof you purchased the car. I would make a nuisance of myself at the dealer, get to see the manager by suggesting loudly in front of potential customers that their incompetence has made your car illegal for the last 6 months...

Can you apply for a log book under the new system? You used to be able to do so.
You can apply for a duplicate. Takes 4-6 weeks as they write out to the registered keeper to confirm they have sold it, and if they dont reply within 21 days they process the new book anyway.

I had to apply for mine when the seller either didn't send it or the DVLA forgot it.
There was no charge. The £25 is for people who already had one but lost it hence why it is a duplicate (unless things have changed in the last year).
As the OP has never had one it should be free. The DVLa will write to the registered keeper saying "someone is trying to register your car" the dealer needs to say "that['s fine" or simply ignore it. I can't imagine that the dealer has registered it to themselves. It is more likely shown as in trade/no current keeper. If the last keeper has told the dvla they no longer own it, I should imagine the log book would be sent by return on application for one.0 -

True. Just going on what the OP has said about the car registered to trade/dealer is all.
