I have received a final response letter from Capital one not upholding my claim for PPI. I took the card out Feb 02 & as I use the card very infrequently I was not aware that PPi was also added until I received an email from Capital one stating there improvements to my PPI in October !!!!!!. I contacted Capital one to be informed that ppl was added to my credit card from March 2003.!!! A year later.
In the final response letter Capital one states in a telephone conversation I called them regarding a different matter and in that conversation I took ppl out.
Do I go straight to FOS as I dispute that this conversation ever took place or do I go back to Capital one requesting transcript of the conversation as I know I did not agree to PPI being added to my account.
The reason for the mis selling is that I did not need it due to benefits I receive from my employer. Also, (I have done this for years)...when sales advisers try to sell me insurance, I always tell them I have cover.
My only mistake was that I did not check my statements thoroughly to realise that the cover had been added for the last 10 years:eek::eek::eek:

Go to the FOS but don't get your hopes up.
They won't have a recording, only a sales patter, and selling PPI over the phone is one way they did it.Non me fac calcitrare tuum culi0 -
Thanks for that I will go to the FOS as I know I did not agree for PPI to be added. My only downfall is that I did not check my statements thoroughly eenough because I was 110% sure I did not have it. Oh well...0

The FOS are currently only overturning around 11% of Cap One complaints. There will be no transcript. There is also no requirement for them to have a transcript or recording. They have a record of their process though and it is this which the FOS have accepted as being compliant with the rules.
The majority of credit card PPI sales are made post application and over the phone. Cap One did not use advisers and did not put things in place under an advised sale basis. They have no requirement to check things that an advised case would have.My only mistake was that I did not check my statements thoroughly to realise that the cover had been added for the last 10 years
That does impact on your credibility somewhat. Someone that complains after a few months of seeing a transaction they did not approve on their statement is highly credible even if the evidence does not suggest a wrong doing. However, the further you go in time the less it looks like a genuine complaint and the more it looks like an opportunistic try it on. Timescale in itself doesnt decide a complaint but it can be something added to the scale where a balance of probability decision needs to be made.
It should also be noted that you only pay PPI when you borrow money on the card. If you pay it in full in the month then you do not pay PPI. You say you used it infrequently. So, maybe you had PPI on the account but never actually paid premiums.
So, as it stands, the odds of a successful overturn are low based on what you have said and Cap Ones record. You may fall in that 11% but nothing you say suggests it (although we only have what you have said here).I am an Independent Financial Adviser (IFA).
