Protected rights

If someone is transferring over to ESA from Income Support and Incapacity Benefit and were on IB credits only, do they get protected rights to keep the same rate of benefit when they transfer over to ESA

On I.S they would get just over £101 with the DP.
when they transfer to ESA would they still get this amount or just
be entitled to £71 for the first thirteen weeks whilst they await their assesment ??

need some advice for friend and am getting conflicting answers so thought would ask here :)

    People being transferred from IB do not have to go through the assessment period, they stay on IB until the ESA decision is made.

    As long as your friend is awarded ESA, they will not receive any less than they did under IB. Nor will the get any rises until such time as ESA has caught up with the IB amount.
