Marshall Ward ripped me off!

I am really angry & upset about this It all started in Jan when I saw an advert for some lovely bedding in a news paper. It was just what I was looking for. I phoned to order the items, but as I do not have a debit or credit card they told me to order the items by post, enclosing my cheque in payment, so I posted my order & cheque for 69.50 full payment for the goods. About three weeks later I recieved, part of my order worth 9.99. I rang the company & was told that the goods I had ordered were now out of stock. I asked for a refund of the balence, 59.51 & was told that this would be credited to my account. I said that I did not have an account & that I had sent the cheque as full payment for goods ordered that I had not recieved. I was told that I would need to prove I had paid them this money by sending in a Bank Statement highlighting the cheque. I did this. They sent a letter saying they wanted photocopies of the cheque, I sent them this!!
1 mth later & no answer & no money!!! they have now had my money 4 mths despite numerous phone calls & 3 letters. Now they are chasing me for a bad debt & rang me demanding I pay. Angry....Yes, have now written threatening court action if they do not refund my money & am at my wits end. I am in a wheelchair & on benefits I can not afford to write this money off, I saved hard so I could have something nice. Any one any ideas as to what else I can do. Ringing is useless as they just pass the buck then cut you off, plus it costs me!!!!

I really hope you get this sorted out!

Just a thought though... they make reference to "crediting your account", although you didn't set one up. When I have purchased things from people like this (MW being one of the worst ones NOT to deliver what I ordered, of course!) it transpires that an account was set up for me, even though I paid for everything up front on a debit card. This was their way of keeping a record for me, of the things I ordered and to make sure they send one of their catalogues through every other month. Therefore, an "account" may actually exist for you on their books, on which they have put the money they owe you. However, I would still imagine that they would be able to see this, and certainly should not be chasing you for payment.

At the end of the day, stick to your guns - you know you are in the right and in the event that they try and take any further action against you, i.e. court action, feel assured that you have all the paperwork to support your side of things and the court will find in your favour. Plus, if it does go that far, you will win and then they have to pay you costs too!

Please keep us all posted, because I for one would love to know the outcome.

    All the best to you

Hi anyone keeping an eye on this, finally got my money back after threatening court action & 3 more phone calls!!! Did not get an apology though or anything for the inconvenience or any interest on the money they had for over 5mths. Will never ever use this company again & would recommend that people do not pay their money up front for goods that you may never recieve!!!!!!!
