Can I claim DLA?

Hello

Just wondering...

Can I claim DLA. I was found at Tribunal to satisfy ESA Support Group Activity 13.

In addition if I applied what would be the a likely outcome?

I was under the impression that ESA had replaced DLA. Although I read DLA seems to be an add on to ESA perhaps?

Any advice would be gratefully received, thanks.

    DLA is for care and mobility and is not a replacement for ESA.

    What disabilities do you have that makes you think you may be able to claim. The criteria is very high.

    There are aspects that seem applicable from the Support Group descriptor 13 I was awarded at Tribunal

    Ive seen the link before, but like I say, it depends on your own care abd mobility needs.

    Only 'some' aspects wouldnt meet the high criteria.

    I had assumed that DLA was just for physical mobility in some way. I used to work as a Motability Car Advisor in a dealership a good few years ago and I didn't experience any applicants other than physical mobility.

    However the link from Benefits and Work above suggests otherwise perhaps for mental health.

    Yes, people with MH problems can qualify for DLA, but as already stated, it depends on your care and mobility needs. Your ESA award will not passport you to DLA, the criteria are quite different. Have you thought about what care and support you require?

    I have being referred to a CPN of recent by my GP. That was evidenced at Tribunal. Going forward tho I am unsure regards a DLA claim at the moment.

    Sja. It is entirely possible you might qualify for DLA... perhaps the care component. You'll be best able to tell. Awards can be very dependent on getting medically supportive evidence - the burden of proof seems to be on claimant and DWP will use minimum they need to deny claims or give low awards.

    You may be able to use evidence from ESA claim in relation to DLA and I certainly wouldn't hold back in using anything relevant or generally supportive. I'd also give relevant claim details to GP and any specialist you name in the application form in case they are asked to provide details. DLA is a benefit for those with care or mobility needs in day to day life... it's a disability benefit... as opposed to an unable to work benefit. It is an additional payment you could get on top of everything else and it may lead to other perks. It is worth noting that DLA is to be replaced by PIP in a timetable scheduled to start this year... so claiming now might not be a bad idea.

    my eldest sister gets full dla based on mental health (mobility and care) - she lost her driving license at the same time... on medical grounds (withdrawn i believe the term was)

    that might by why you only got physical disabilities.

    I know people who get DLA for CFS / ME, but have also lost their license on basis of medical grounds etc. - anything to do with the brain tends to mean that your not fit to drive (not always, but often ;) )
