Issues with IVA, help needed

Hi, I was wondering if anyone could help me please....

I paid my IVA off at the end of June by F&F settlement. I was told at the time that it would take up to 3 months for my IVA to complete and for my completion certificate to be issued and sent out to me.

It's now been 6 months and I still haven't had my completion certificate. I am starting to feel anxious about this as I have paid all of this money to settle and I still don't have the end that I so badly want.

Another thing which is worrying me is that I received a letter in the post a few weeks ago from the company who were dealing with my IVA, the letter was about PPI claims, they want me to sign some paperwork as they believe that I could be entitle to claim for PPI but they are saying I am bound by my IVA to sign the paperwork. I am worried that this is just going to make everything drag on even more... I don't even think I took out any insurance on any of my loans or cards either....

If anyone could offer me any advice on what I should do about any of this I would be so grateful. I am planning on giving them a call by the end of the week.

  • Firstly, congratulations on 'completing' your IVA.

    Which company are you with?

    I know Grant Thronton for example are holding up a ton of completions pending PPI claim investigations. (One GT customer I am aware of has been waiting 20 Months for his CC, pending a PPI claim).

    The PPI thing is a mess frankly, but the legal opinion is that any PPI refund is an asset / windfall for IVA purposes - it all goes to increasing creditor dividend. Thus the IP has a right to ask you about it, and you are obliged to cooperate accordingly (so I understand).

    I think fighting it is only going to hold things up further (I know of someone saying that they had PPI, but did not consider that they were mis-sold it for example. He is still wrangling over this with his IP, and 15 Months later, is still waiting for his completion cert. My guess is he won't get it until he allows his IP to do whatever).

    I'm going to speak to my IP at my 1st annual review, and ask them to do a PPI claim thing then (not that I ever took out PPI insurance), so that the investigation will be done and dusted well before IVA completion, so as not to hold up my CC.

    I too completed IVA in June and was told cert would be forthcoming in 3 months. However, there were issues with HMRC and vat claims and also PPI. I never took out PPI and was convinced I had no claim but I had to sign numerous forms ( at least 20) over the last few months and it appeared I did have a claim from a loan 9 years ago!!!!! Anyway because of the back log I have been told my final creditor meeting will be sometime in March!!!! So fingers crossed.
