Euro Car Parks "PCN"

Options
Sorry if there are a million and one threads on here about PCN's from private parking companies - I have read through some of them but it appears that something has changed since 1st October on BPA registered members. Is this the case or should I still ignore their "Parking Charge Notice" ?

I have watched the video that someone provided from Watchdog and felt confident not to pay their £40 demand if paid within 14 days of the notice, however, I am not so sure now Ive read about this 1st October thing - am I getting confused here??

If I have got confused, then bring it on, look forward to receiving 22 different "demands" from them and their so-called collection agencies, but if someone could put my mind at rest that these modern day !!!!!! Turpin's are out of order then that would make my New Year ! :rotfl:

Nothing has changed about the enforceability of these invoices, if you receive one and you own the vehicle you can carry on ignoring. The only thing that has changed is that parking companies can go after the RK of the vehicle, that hasn't changed from pre October.

You can go to popla and appeal it and cost them money, but it's not really worth the hassle if you don't have the time to handle it, ignore takes no effort or time.

    :T:T:T:T Nice catch!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks Real Ale Drinker - I certainly didnt see that one - I have tried to search the forums but there is some confusing information in them - presumably now after the post you just sent me even though they can now harass the registered keeper (due to this so called Protection of Freedoms Act 2012) - this still doesnt mean jack and I can ignore their letter?

I know its perhaps frustrating for all those on the forum who regularly post about this sort of thing, but as a "newbie" I came here for some advice and reassurance. Thanks for taking the time to post the second thread to me...

You read my reply above I can see, and you still asking whether pofa 2012 means you should pay. I will tell you again to avoid doubt. Nothing has changed to make these fake tickets any more valid than previously, you have an invitation to pay an invoice for an alleged breach of contract, you don't have to accept that invite.

Some statistics from 2011 as an industry

    1.8m fake invoices given
845 claims issued in the small claims
49 proceeded in front of a judge
    25 found for the motorists
    24 found for parking companies

In 2012 we expect that to be less due to vcs v hmrc upper tribunal court case (google it) the judge said that the parking company has no legal right to offer parking or take it to the small claims.

2013 promises to be more of the same

  • Thanks Stroma, for the clarity - I am now incredibly confident to carry on letting these !!!!!! Turpin's waste their money sending me more letters ! Bring it on - I will be following some of the other forum posts now that detail the names of the companies that send follow ups as well as these Debt Collection Agencies who all appear to be from the same registered company !!

Thanks and Happy New Year to you !
