how to deal with this store (and speed up the process) ??

Hi All,
I'm looking for some advice with the following:

I recently (under two months ago) purchase a very large animal cage for one of my chinchillas from a local small scale pet store

When I got it home and unpacked it, several of the pieces (it's a metal framed cage) where bent out of shape... although I was able to get some to fit, it then became apparent that in fact some where also broken and poorly welded together.

I telephoned the store who advised me they had just taken apart the store model as it too had broken, and could I bring it all back down and see if we could make one cage out of the two..


So I did exactly that, and luckily the pieces that were broken or bent on mine were ok on this store model, so we swapped pieces and I then had a fully functioning cage... (or so I thought)...and the shop were going to send back that store cage as it had broken anyway.

The cage model in question comes complete with casters to allow it to be moved about easily (chinchillas don't like heat so I have to move the in and outdoors to keep them right)... the first time I came to do this about two weeks ago ( with the heatwave).. when moving the cage, one of the legs with the caster simply buckled and snapped on me. I was not pushing hard or using excessive force etc.. just pushed it to move it and SNAP!


So I telephoned the shop... he said he was aware that that particular model was causing a lot of problems and both he and the manufactur had had problems with them. So much so that they had launched a new model with a different design to solve all these issues (I've seen the new cage - my sister has bought one from the same shop -and it's much better)

I asked him what he was going to do about my broken cage and he said he would get onto the manufacturer and get me a new cage sorted out.

Since then I've had to telephone him for updates all the time (nearly three weeks have passed), and although he's pleasant, he's not exactly breaking his neck about the issue (I guess there is no money it). Meanwhile my cage is sat here propped up on one side with books!


Evertime I ring he says he's telephoned/emailed the manufactuer and is waiting to hear back.. But I don't see why I should have to wait for him and manufacturer to sort something out- I want this sorting now.


What should I do?

    I'd contact the maker of the cage directly and ask them what are they doing about it - if anything. Followed by muttering Trading Standards at them and the petstore owner if no help is forthcoming. I think I know what sort of cage you mean and they are a pain as they are so flimsy!

    I'm sure that I'll be corrected if I'm wrong, but I think that your 'contract' is with the store that you bought the cage from & not the manufacturer. So it's up to the shop owner to sort it out for you

    so am I in my rights to ask for a new cage from him, regardless of whether he has that sorted with his supplier?

    Yes.Its the Sale of Goods Act>Your contract is with the supplier ,not the manufacturer,always.

    Well,sorry, i should say,he is not a magician.you are definitely entitled to a refund.You cant make him obtain another cage but asking for your refund might concentrate his mind

    well I'm no further forward with this.

    I do feel sorry for him, as he is in the middle. His supplier is saying yes they'll send out another cage for me (the one in his shop has also bust and he' awaiting his own new one as well (both new deisgn to fix fault))

    but they emailed him on the 29th to say they would send it, and still nothing.

    My wife is pregnant and the reason we bought this particular cage is it has wheels (this is where the fault actually is), and so can be moved easily. The animals in the cage need moving to different rooms in the house quite a lot to keep at the right temperature during the sunny days.

    So at the mo, this cant' happen and my wife can't manually move the cage either.!!!

    Driving me up the wall...
    I've given him till this Friday to get a new cage in otherwise I'm going in on Monday for a refund...
