bought item, it has missing parts! HELP! (seller is not helpful)

Hi,

I have just bought a printer from eBay and it stated in the description that it has Ethernet.

Received item, but Ethernet card is missing, asked seller to send missing part but they wont.

They say it was sold as a HP4000 not a HP4000n (being the networkable printer)

The item I got was a HP4000n but no network card.

I bought this item because it stated in the description they can select for what features it has, that it has Ethernet and Paralelle.

If the printer was 'sold as' a HP4000 with no Ethernet card, they should have sold it as a HP4000n (NO NETWORK CARD)

I do not know the difference between them, now I do! that said they should not have listed it as having Ethernet and paralelle.

I have contacted eBay and now PayPal to file a claim, and still the seller says send it back if your now happy, (but read the conditions before sending back)

Their condition state that 'I' pay postage cost to send back!!!! £25- !!

I already paid this to get the item to me in the first place.

They want me to now buy the missing part, outside of eBay!, as a further cost of £12.99 + vat + £3postage = £18.79. (second hand!)


I called PayPal and they advise me to take it to a small claims court, as they strongly beleive I have a good case to win.


PayPal has put it to the seller they have three options, i post back for full refund, seller to send out missing part, part refund so i can buy missing part.
I favor the last two options.


If you think i have a good case please advise how i file a cliam with a small claims court, i have no idea.

    I think paypal are jumping the gun a bit. Why are they advising small claims when the dispute is ongoing?

    Let the dispute finish, then worry about further action.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • PayPal have already asked the seller what they want me to do, but the only options i have in the resolution page is to accept the offer of a refund of the item cost, (not postage of £25 or the postage cost send back!) or to close the dispute and forget it.

    The seller has not budged for over a week now, do not think they will either.

    Just wanted to get a bit of info about what i should do if it did come to this.

    I'd say it would depend very much on the figures involved.
