No refund until goods collected?

I have been in dispute with them over faulty treadmill purchased Feb 2012 which broke after 4 and a half months. Have been without working one for 6 months now and still waiting to get this sorted. They have acknowledged receipt of my last email rejecting the replacement offered (my model no longer available) but no response since, which was 3 weeks ago. They may offer you repairs, replacements and even to send you parts for you to fit yourself. I have had motors, circuit board, speed sensor, console and and back wheel replaced as well as their own engineer come to my home to try to fix it. What ever you do, DO NOT accept another treadmill, repair or replacement and insist on your refund even though you may have to wait 30 days for it. You are covered under the Sale of Goods Act as you have not accepted the treadmill within the timescale needed so should be entitled to a full refund. For me, as I had 4 and a half months use of mine, at best I can maybe get a partial refund which they are refusing at present. I have sought legal advice and am following the steps needed to try to resolve this at best as possible but have been advised that I may need to go to small claims court, which I am prepared to do, if all else fails. Good Luck!0

Why did they not take the 1st one away when they delivered the 2nd???
Make sure you get it writing from the courier that they have picked up the goods.
I take it you paid via a card. As such there are possible chargeback options if the retailer is being difficult in refunding.
In fact visa regs state that a retailer has to refund in 15 days of the goods being returned. If not a chargeback can be actioned...Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
Thanks for all of your replies. They emailed on 7 Jan to say that a refund would be actioned the following day and would take 5 days. I spoke to my credit card company yesterday who said no refund had been received. Emailed company again today who say that they will issue refund tomorrow.
