Partner being held liable for his ex's debt...

    Ask for a certified true copy of the credit agreement with your signature on it signed on the 22nd of January.

    It shouldn't exist.

    Sadly not. All the paperwork got left at his old address and there's a good chance his ex destroyed it all.

    i did this through wescot with 2 bills
    one was a telephone company i asked them to provide the original agreement and if it was me ile arrange to pay it

    the 2nd was a catalogue bill the ex opened one in my name at his address
    this one was a little different i asked them to provide me with what i was being billed for an what dates as in the debt was 500 and i wanted to know what i had supposedly purchased

    they told me later on that they sent the debts back to the company for them to supply me with the info

    never heard anything after that as they couldnt prove it was me and i couldnt prove that it wasnt

    see they have to provide evidence that the debt is yours i reckon if u ask wescot for the info they will say they dont have it so you ask bt who will say they probally dont have it either so you tell bt to call off wescot an you could also ask them to wright to the credit reference angency as well as there will be a mark on your name for the debt

They will threaten county court action, but the likelihood they will do anything is probably less than zero.

    Nope they were in his sole name and debts incurred after i left him, but they must have been able to prove something as i had an attachment of earnings !

All they will do is try and bully you into paying, threatening 'door step collectors' will call. They will threaten county court action, but the likelihood they will do anything is probably less than zero.

    I totally agree with the Pond Life comment!! lol!!

    Do they really just give up on you in the end? They seemed pretty tenacious...

    That was certainly the case 20 years ago - with a slight twist.. I had to write to the bank saying I would no longer be considered responsible for (n0w ex) wife's debts.

    Think the law was that you were assumed responsible unless you said not.

    I remember seeing a small notice once in the back of the local paper stating that Name as in no way responsible financially for other name and was not responsible for any debts incurred, this was placed by a firm of solicitors and yes this was at least 20 years ago. From what i can remember it was a legal way of separating the money and keeping what is yours when separating or going through a divorce

    so he is still married to her-and not being funny but his name was on it, this is why i avoid my name on bills now (i live with students in shared house) I dont want the hassle when people try to screw you over

    sadly tho, as it is in his name, he is responsible,
