Can you return mobile phones

i bought a phone for my partner for xmas, which he does not like. he has had the phone out of the box and used it for an hour. do i have any rights to return the phone. i bought it from a company on ebay who sell loads of these phones.
Just about to give up!

I dont think that would be fair as if you return it the seller would have to sell it as used and take a loss. Its not fair to the seller, Maybe sell it on ebay yourself0

Under DSR unless the seller did not meet some of the necessary requirements then the buyer only had 7 days to return the phone.
Distance selling regs allow a 7 day cooling off period once item has been received to change your mind, it is not unlimited!if i had known then what i know now0 -
Presumably, you bought it before Christmas so youre past the 7 days.
Sell it on Ebay.make the most of it, we are only here for the weekend.

If you are cheeky contact the seller, they may offer an exchange for a better product, if you're willing to pay more. I'd expect them to charge for restock/returning item, if they will accept.
It's possible, given seals, etc on new mobile phones that DSRs don't apply but I could be wrong.0 -

I'd hope so - there is a huge difference between a simple change of mind and taking something out of the box, turning it on and messing around with it for an hour (doing who knows what damage in the process!)0
