Maternity pay and legal aid

Hi
Up until recently I have been unable to get legal aid due to my partners wages putting us over the threshold. However, she has just gone on maternity leave and is 2 weeks in of her 6 weeks 90% money.
Because she is on maternity allowance will that help in the case of claiming legal aid or will we have to wait until her wages go down to the £130 satutary pay in a few weeks?
