Taking a coat back to Primark - rights?

I was given a coat for Christmas which doesn't fit. My friend gave me the receipt.

I was going to take it back today to exchange for another size, but no other sizes. I then noticed she paid with a card, so I called to see if we could meet up - live half an hour apart, but she said she no longer has the card.

I do appreciate Primark do not have to do anything but do you think I may get credit with the receipt and no card? Does my friend have to come to shop with me?

I could pass the coat on, but it's worth asking in case someone here knows.

    Hi I would think you would be offered a credit note for the value of the coat. The main thing being you have the receipt as proof of purchase.
  • As above...if you have the reciept I would imagine they would give you store credit :)
  • But they're not obliged to if the coat is not faulty.

  • I swapped a bag once without the receipt. They are more than likely going to give you store credit. if not ebay it :)

    To save waiting in two queues find something you want to exchange it for and take that with you when you queue up at customer services to get your refund.
  • Primark don't do credit notes. You will only be able to exchange or get the value credited back to the original card. I would take the advice of choosing what you want to exchange the coat for and then go to customer services.

    As the coat is not faulty or damaged, Primark is not obliged to exchange the item or offer you a credit note or gift certificate to the value of the coat.

    I hope the store you take the coat back to will allow you to swap it (with the receipt) for alternative goods. That might well be the best you can hope for.

    Re-gifting or selling the coat on ebay might also be alternative options should Primark not be able to offer a solution to your satisfaction.

    There are two issues here - 1) the coat is not faulty and 2) the coat was bought by someone else.

    Addressing the second one first - the OP has no statutory rights at all, regardless of the fact she has the receipt. The person who bought the item has the contract with the retailer, not the gift recipient. When people used cash all the time, this was by-the-by provided you were given the receipt along with the gift because no-one would know you weren't the original buyer. However, if the item was paid for by card, most shops insist that any refund goes back on the same card, hence it's now more difficult (and sometimes impossible) to obtain a refund if you're not the original purchaser.

    Taking the first point, you have no legal right to exchange items that are merely the wrong size, nor get a refund. However, if a shop's policy allows refunds and exchanges for unwanted items (and many do) they must honour this.

    To further complicate matters, if Primark did allow an exchange this wouldn't be a statutory matter (merely shop policy) therefore the point about the contract between shop and purchaser that I mentioned first might not be an issue - Primark are free to make their own rules (provided they don't affect your legal rights) and may be happy to exchange or refund on the strength of the receipt alone regardless of who purchased the item.

    In this situation, realistically I think the following will happen. If Primark have a returns policy, they'll be happy to exchange with the receipt alone. If only a refund is possible, because there are no suitable sizes available, the person who bought the gift will need to be present. If they don't have a returns policy, it's eBay for the coat.

    I was able to take the coat back no problems :T :T. Excellent advice here to pick the other items up first to save re-queuing so thank you.

    I managed to get 3 tops, work trousers and jogging bottoms as they were all in the sales.

    She also said as I had the receipt but not the card, she could refund to a different card. Apparently it happens a lot in December and June that cards run out and new ones are sent out from the bank (obviously with a different card number) so they understand and refund to another card in that instance.

    But I'm more than happy with my swap.
