Advise needed for tree work!

[/SIZE]A tree on the boundary of my home has a Tree Preservation Order on it. As a responsible and law abiding person I obtain permission from my local planning department to undertake some work to it. Also, engaged the services of a reputable tree pruning firm to carry out the work. However, everytime my contractor looks to commence work my helpful neighbour threatens legal action if material from the tree lands on their land. Oh, forgot to mention their land is on the other side of the boundary on which this tree sits. I have approached and tried to allay any fears they may have about the proposed work but without success.

Any help will be much appreciated. Thanks.

  • I am not a lawyer.

Anything you cut off the tree belongs to them anyway, and legally you have to return it.

Is it just the fact it might fall, and damage something? Can you discuss this with the contractor, and perhaps get them to explain to the neighbour how it works? It's not like they just let branches drop to the ground... :D

If you have obtained permission and are using a reputable tree pruning contractor what legal action can they threaten YOU with.
If material cut by the tree contractor falls on them and does damage to their property it will be between them and the tree contractor and their insurance company.
It will not be your problem.
Just tell the tree contractor to get on with the job but warn him that the neighbours are up for a row.....make sure he knows that he is being watched and that everything he does should be done within the law.
