If my bank phones to settle out of court just b4 court date, I know you need to get them to put it in writing first, but if say there is only 2 days b4 court date what do I do.
Do I cancel the court proceedings and risk them withdrawing their offer and make me go through the process again.
Maybe I could ask them to email me with conformation.

Personally I wouldn't cancel the court procedings until the money was in my bank account. There is nothing to stop you going to the trial and stating the defendant has made a verbal agreement but you have not recceived the money yet.
You would hopefully get an order from the court that would reflect the fact if the money doesn't show up you may carry on the case.
If you stop procedings then the defendant doesn't come up with the cah then you would have to start all over again. Worth the risk?0 -
