    It sounds like the OP is in a horrible situation and has come here for help so, rather than berating her for spending so much money on clothes (which clearly was an error of judgement), perhaps posters should only respond if they have genuine advice to offer?

  • Sorry to hear about your situation.

    Like has been suggested it sounds like your priorities were a little off when you spent the majority of your funds.

    Your priorities still sound like they are a little off as I would have thought by virtue of you being homeless your first priority would be to get back home rather than take an airline company to court.

    Your best bet would be to contact the Embassy/Consulate of your home country as has been suggested and then consider whether this is a fight you want to/can afford to progress.

    Jeremy Clarkson directed a maelstrom of abuse at American Airlines’ Twitter account after the airline lost his wife’s bag when they flew in to Miami.

    The Top Gear star, who isn’t afraid to air his opinion, said: “American Airlines. I have acquired a special set of skills over many years. Find my wife's suitcase or I will find you. And I will kill you”, taking inspiration from Liam Neeson’s hard-man character in Taken.

    He went on to Tweet: “American Airlines. Literally the worst thing.......in the world” and “American Airlines: the bag you lost contains the secret for bringing peace to the Middle East. Please find it quickly.”

    Can anyone tell me, now I'm better placed to pursue this, why an American airline thinks they have any less liability than a UK airline when it comes to duty of care over a person's luggage? Especially when US Airlines charge to look after your check-in bags?

    I need to know why Delta claimed they "were not liable." Were they merely trying it on?

    What exactly is it your claiming for? The damaged items/bag or the things you bought? If the latter, unless you had received prior permission to spend money on new items, I would not hold out much hope of getting these expenses refunded, especially if you spend money on gifts or other non-essential items. In fact, I probably wouldn't even bother. Delta does say that they will refund reasonable expenses up to $150 over the course of 5 days but you need to save receipts. My advice would be to focus instead on the damaged bag and the missing items. It is unclear to me what the status of this claim is since you focus so much on the money you spend in your posts. Has Delta explicitly refused to compensate for this (again, I'm talking specifically about the damaged bag and the missing items, NOT about the items you bought)?

    My experience of this is that you must check your bag fully while still in the baggage hall - and make sure nothing is missing/damaged then, and as jpsartre says they normally give you an allowance for you to recompense yourself.
    Sorry i cannot help with your situation now, do you have legal cover with house/car insurance? They maybe able to give you some free legal advice on the phone, or perhaps a board here may have a solicitor who will give you advice on pursuing a claim?

    Your initial post is way to long.

    Your claim for lost/damaged bag is with Delta, you will have to pursue with them, but i am thinking the claim should have been made in the baggage hall before you left the airport

    But what is the status of the claim? Did you fill in a report online within 24 hours of receiving your bag? Is it still being processed? Has it been denied? If so, what was the reason given. Be aware that valuables in general won't get reimbursed though you should get some money back for the suitcase and lost clothes (though I doubt it will be anywhere close to £1100).
