    It is a civil matter. Get a lawyer to help you.

    Having a car with a mystery noise is a damn good reason for selling it, not buying it !

    Contact the seller and inform him there vehicle was now legally yours as the sale was complete, he did not have the authority to scrap the car and unless he returns the money you will be going to the police to report the theft of the vehicle.

    EDIT just read your reply. Push and push the police. Permanently depriving somebody of goods rightfully yours is an offence.
  • Why iit a civil matter and not a crime.?

    The mystery noise didn't bother me as the reduced price would compensate for any garage bills. Also after reading up on the fault it urns out what broke would have only cost a couple of hundred to put right.
  • Is the vehicle legally mine? I have the new keeper slip but no receipt of payment.

    You became the vehicle owner once the sale was completed ie. you paid and the car was given to you. The registrant document is merely who is the registered keeper, this isn't necessarily the owner. Your green slip should be sufficient in proofing a transfer of ownership took place.

    I'd say this is civil.

    Yes it can be argued that they had no right to scrap the car. However had the op accepted the vehicle?

    Had he bought it from a garage and they were saying the noise is not our problem, you'd be quoting sale of goods act.
  • Ok so what if the seller has scrapped it (unlikely but I'd rather have a plan if he has)?

    Ownership transfers straight away.

    It's a private sale so sales of goods act is irrelevant. Plus op knew there was a fault and purchased as such.
  • I had accepted the vehicle, only returned it them as I didn't want to leave it on a main road. It was the following day when I was told the deal was now off and the car had been scrap. ped
