item received with no postage si I have to pay...Help?(long)

I bought a top from ebay it finally arrived after a reminder to seller. I paid instantly on 14th so 10 days later is not good enough for me, apolgies of being away etc (don't sell if your going away is my thoughts)....Anyway parcel has no postage so means I have to pay....here is my email to them and then there is theur response. I'm not going to persue through paypal as it's not worth it incase I need to claim for something more expensive at a later date...but would like to know techinically who is right. As a seller myself I would refund and then claim from the post office.

Hi, I have just arrived back from my local sorting office after I received a letter saying there is a parcel for me but I have to pay. As you have not pr0vided a return address, I would have just asked for return to sender. I have had to pay £1.20 delivery fee plus £1 handling fee as you haven't paid any postage or if you have put stamps on they haven't stuck to the sellotape. So I am asking for this back and I am very unhappy with your service which is already way too late.
Please send the £2.20 to my paypal account XXXXXXXX.com or I will have to persue this through paypal.I can forward you a photo off parcel with sticker showing my payment if needs be. Please do this today, regards XXXX

XXXXX - I'm sorry if you are left disappointed BUT - let me assure you all postage has been paid and I have receipts. There is no reason for any demands for payment. If the stamps have come off then it is down to the post office as these items are passed to them and THEY stick the stamps on once its been weighed and passed throught the hatch. I would strongly argue the case I can provide details of all the postage.
In terms of lateness - define late for me !!!!
Do not take issue with me. I never offered postage insurance, you have the items, Why should I have to pay for postage twice and why should you. It is not my fault. How can it be that there was never any postage paid. The post office would never allow me to pass this item over to them.
Sorry for my response - BUT this is not my fault and your tone has angered me. I'm sure we can come to some agreement, but please do not demand I pay and that I am at fault.

    If I were the seller, I wouldn't have liked your tone much (slightly demanding), but I would have still refunded the £2.20, and reported it to Royal Mail, as it seems the stamps/label has come off in the post.

    I would claim the packaging had been damaged.

  • It's your word against the seller's I'm afraid. It's frustrating I know but not worth arguing about. You have stated your case with the seller and have received his view on the subject. Best to chalk it down to a bad experience and as the seller wasn't very sympathetic or helpful in his answer, if it makes you feel any better, don't buy from him in future. For the sake of a couple of pounds, he's lost a customer.

    I think the seller (if they choose to cooperate) can go to the PO and claim for the postage + fee by proving with their receipt that they did pay for it.

    Perhaps it's time for a conciliatory email -

    I apologise for my tone, but I wasn't very happy that I had to wait 10 days for my item, and to have to pay again to get it was the last straw!

    It sounds as though the PO sticker came off the package - obviously, from my end, I have no indication from the package of whether you handed it over the post office counter, or just stuck on stamps which later came off.

    I believe that it's possible to claim with the PO the extra money incurred; you prove that you paid the postage, and show that I was charged. I hope you'll be willing to do this and hopefully do a partial refund to me when you know if the claim has been accepted.

    Sorry again for jumping in at the deep end.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    I understand where both you and the seller are coming from. This happened to us a few times, the PO were sticking lickable stamps to the plastic parcel bags and they came off. Our buyers then had to pay to get the item. We knew we had paid the p+p, how else does it get put in the sack if it doesn't have stamps on it? Anyway, we did refund our buyers and learnt from our mistake. Now we get the PO to print off the sticky labels and they are much better.

    Your seller did say that they are sure you can come to some arrangement. Ask if they can refund half of the charge you had to pay and chalk it up to experience.

    The problem is you have a couple of issues here. You have to choose your battles and win them one at a time. I don't think i would have mentioned anything except the excess P+P in my first salvo. You can also prove you have paid again.

    Can you scan the packaging and ask them to refund whilst they chase it up?

    I try not to get too confrontational early on just gets folks backs up.

    I'm sure I'm not in the minority here, but regardless of any perceived "tone" from the buyer, I would have immediately refunded the p&p charge (providing I had photographic proof) and later taken the photographic proof and postal receipt to the post office and asked for a refund.

    I find it works the other way too. If I have a confrontational message from a buyer I reply in a very sickly sweet apologetic (through gritted teeth) way and most often they end up thanking me and apologising for their original message.

    Yeah ok, I agree I was a little harsh but in my defence I did have to send him a reminder as to where my top was on day 9 to which he replied sorry been away on business have posted today....I guess my real gripe is that....when i went on holiday I made sure I had nothing ending a week or so before and I still logged into my account to check for mail, there were a couple of issues and I replied that I would deal with them as soon as I got back.
    I strife for high standards and expect the same from others.....but I guess not everyone is like us lot!!!!
    I will put this one down to experience.
    On another note, a while ago when I was having a stressful day I posted 2 cheques but silly me forgot to put on any stamps......I (rightly so) had to pay the extra and did so without fuss.
    Anyway, just a bit stressed today so sounding off a little....thanks guys for letting me off-load....:)
