NTL late payment fee...

ntl (virgin) have slapped on a late payment fee. £10 I cannot have direct debit as my money is NEVER guaranteed to be in. (benefit) which would then incur bank fees for going overdrawn.
One can apply for getting late payment charges back from your credit cards, banks,so can one also apply for getting back late payment fees from ntl? as its the same principle.?
