Hi there,
I wonder if anyone can give me any advice please.
I tried to claim back some bank charges back in 2007 with RBS but my claim was put on hold until after the court ruling in 2009. I then received a letter from RBS saying there was no chance of getting my charges back (approx £1500) because that courts had ruled in the banks favour.
I then re-submitted my claim last year as at the time of the charges I was in financial hardship and was also occuring a snowball of charges which I couldn't clear and my wage was very low and wouldn't cover the charges (its worth noting I then started a DMP and the account was fully settled in 2010). I heard nothing back so last month I sent yet another letter and I received a general letter last week saying they were looking into my complaint but they didnt give an indidication as to when they would get back to me.
So I have a couple of problems. Firstly, as these charges are now over 6 years old will they still look at this considering I have been trying to claim these back since 2007? Also, I am in dispute at the moment with RBS regarding a default they put on my account back in 2007 which is due off in December next year but I want to try and shift it sooner, and I am concerned that trying to claim back charges will affect the default claim?
I am no longer in financial hardship so I dont know if this matters, I think I can claim because at the time of the charges I was in hardship. Does this sound correct?

The hardship claim is if you are now in financial hardship not back when the charges were made.0

Cases should not have been put on hold if you were in financial hardship.
A shame you allowed it to be; the banks were paying out 5-6 years ago to those in your situation.
But your ship has now well and truly sailed.
You could raise a complaint about the disputed default, but after 5 years and the FOS taking over 12 months to handle banking cases (if needed) you might be better off just getting on with life. Your default will be gone next year anyway0 -
Just to give you all an update on the above.
I wrote to RBS on 10th December questioning the date of the default. I received a letter last week stating that they will review and amend the default date on my credit file and it should show by the end of January.
I have now managed to get all 3 of my defaults removed in the last month alone so its definitely worth a try for any of you who are thinking about it! :T0
