Fraudulent Item - User no loner registered!

Hi,

I bought a watch off Ebay and when it has arrived it is clearly a fake. I logged back into Ebay and the seller is now classed as 'no longer registered' despite having over 250+ positive feedback when I bought the item from him.

Is there any way I can chase him for the money apart from sending a few ugly men round to his house??

Did you pay by paypal? If so you can file a claim, I paid £60 for a pair of fake trainers, all they asked for was the reason and then after their investigation they refunded me the money, it took about 2 weeks. I think the claim limit is £500 but this could be wrong. Did your payment exceed this?

If you paid by cheque/postal order then theres very little that can be done, it was most probably a hacked account if the seller had lots of good feedback.

Was the feedback for items similar to what you had bought? i.e. other watches?
  • if you paid via paypal file a complaint as vincenz states, if they are no longer registered, you may get your cash sooner than the 2 weeks, as paypal will realise this.

if you funded a paypal payment with your credit card, ring your card company and tell them what's happened, they'll perform a legitimate chargeback for you.
  • Unfortunately, did not pay via Pay Pal. It was a bank transfer.

Ouch. You can still try an ebay standard protection claim - I'm not 100% sure they will pay out, as ebay don't seem to know themselves whether bank transfers are covered, but it can't hurt to try.

They will deduct £15 from the refund and I believe the max you can possibly get is £105.

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

Thanks. How do you go about starting one of these claims?

Got a link to the auction ? If you can put a link, maybe someone here could see if it looks fake etc, give a bit of advice to others who might be considering buying similar watches...

Heather, go into paypal and open a dispute there.

If that fails, hopefully you funded the payment with your credit card and can take it up with them. But try the paypal dispute first.
