    He gets two weeks 'sick' on JSA a year.
    It may be possible to modify his jobseekers agreement, as long as he is looking for work of >16h/week.
    After this, he has to claim employment and support allowance.
    If he claimed now, his claim would be in the same year as his JSA claim, so he would be entitled to contribution based.

    He would initially be claiming for a period of 13 weeks, and then he has (generally) an appointment to see how his disability affects him.

    Is it a work injury?
    If so, IIDB may be an option.
    If he can through a combination of sitting and standing, remain at a workstation for an hour, he may find it difficult to qualify for ESA, due 'just' to a bad back.

    If he was accepted into this group, he would be paid ESA for one year, then it would be affected by your salary.
    http://www.tameside.gov.uk/esa/lcwra - and the support group - if he matches any one of these, then he gets put into the support group, which has no limit of time.

    You are claiming council tax benefit, child benefit, child tax credit?

    If he failed the above test, and he chooses to appeal - with his doctors backing - then he will be paid at the assessment rate (same as JSA) during the appeal process, which is likely to take some months.
