Alleged car accident

I have had a claim made against me that I reversed into a vehicle 30th October.

I have had NO accident and this women has involved the police and her insurers to allege I have 'hit and run' from her vehicle. I was sent a letter stating an intent to prosecute from the police. Lovely. I was in the area but the vehicle was not been driven at 8 pm when this was supposed to have happened. I was also parked further down the road from the address. This 'crash' was reported to police/insurance two days after the 'incident'.

I have had an independent party look over my vehicle - normal wear and tear. Now it turns out her insurers have closed the case as the cost is below the excess. It's a grand sum of £45!

What I am confused by is the next stage set out by my insurers. I am to be pursued by an accident management company?! Does this mean I am still under the sword with regards to this affecting my premiums? Very. Very. Frustrated.

  • I would write to your insurers, the police & the "victim".
    Send it Recorded Delivery, so it has to be signed for.
    I would state that I was Not involved in any accident, on the specified day.
    Any further allegations that I was, will constitute Harassment, and will be dealt with accordingly.
    Unless you hear from the addressee within 14 days, You will consider this matter closed.
    A case of; Put up or shut up.

    It seems that they have already 'put up' by sending the letter stating that they intend to prosecute. They have 6 months to bring the prosecution for a summary offence.

    Have you spoken to the police OP, what did they say, What did your insurance co say?

    What reason have they put forward for believing it was your car involved?
  • I have spoken to the police and submitted my statement about the time and place of my car fully refuting the claims. I included photographs. I have yet to hear back from the PC handling my case. It seems like a complete waste of the police's time tbh.

    They believe it was my car as she noted the registration and time at 'around 8 pm' and saw my car hit hers and drive off. It was parked on a private drive down the road from her address from 7.45 until 8.30. At no point did I hit her car and 'drive off'. I think she has a case of mistaken identity and played the car reg lottery.

    I just don't understand how her insurance has closed this case and a management company is now chasing me? Does this still affect my car insurance when I come to renew and have this still rumbling on? This has cost me a fortune in phone calls to keep chasing up.

    rather puzzled by this, as if you read my post earlier this evening,
    I'm maybe on the other side of the fence,
    i.e, someone else possibly saying they wasn't there who hit me.
    when i informed the police later, they told me it has absolutely nothing to do with them, its a 100% job for the insurers and their investigation team to sort out, no way will the police get involved,
    basically it boils down to proof that you were there and that the insurance investigator could prove it,
    the police won't have anything to do minor incidents according to advice given by them, fraud or not.

    So you write to them giving them 14 days to respond and if they do you'd consider it to be harassment?

    Whatever you do, do not pay the £45 - just to get rid of the hassle. The £45 payment would be equivalent to you admitting liability.

    Apparently a person has up to 3 years after a road traffic accident to claim for personal injuries.

    If you pay the £45, you could see yourself being held liable for any subsequent personal injury claim. You don't want to see yourself at the receiving end of what may well be insurance fraud.
