Imdemnity insurance claim

i am looking for some advice regarding an extension built on the house we have just bought. the search results from the solicitors found that the previous occupants had a small extension built at the rear (i think its classed as an orangery or sun house, not quite big enough to be a conservetary). as the house id a reposession my solicitors have told me that i need imdemnity insurance as planning permission wasnt obtained, so i have agreed to pay for the insurance. what i would like to know is am i able to now claim on this to have the extension ripped down and rebuilt to the building regs standards as im concerned about the safety of the extension seen as no documents can be provided to say that the extension is safe. for all i know some cowboy builder could have thrown this up with no regards to the safety and security of it and lack of planning permission surely rings alarm bells.
so am i within my rights to have this done or can i only claim on it if something was to happen, such as the roof of the extension came through or the wall became unsafe?
any help or advice would be appreciated.

  • Not normally, it covers enforecement by the council for the lack of planning permission, not structural issues with the extension or your decision that you simply dont want it

    As II says, it's legal expenses insurance against the council taking action over the lack of permissions.

    FWIW it may not have needed planning permission if it was within permitted development;-

    You have misunderstood what this policy is for.

    It won't cover what you are looking for.

    Get your solicitors to explain things fully to you whilst you are going through the purchase as once the property is yours it's too late to do much about anything you have agreed to without fully understanding it.

    That would be a fantastic insurance policy!!!

    As stated already, the indemnity policy is providing cover in respect of the structure having to be removed because of the lack of planning permission - i.e the council demanding that the structure is removed because of lack of permission.
