In the CML Handbook for Emgland & Wales (assume that's where property is) (the legal stuff solrs have to check for lenders) there is the entry about Environmental searches:5.2.5 You must advise us of any contaminated land entries revealed in the local authority search. Check part 2 to see if we want to receive environmental or contaminated land reports (as opposed to contaminated land entries revealed in the local authority search). If we do not, you do not need to make these enquiries on our behalf.
5.2.5- Do you want to receive environmental or contaminated land reports?
No - simply advise us of entries revealed in the local authority searches relating to contamination.
The first para there is standard wording that applies to all lenders - the second one is Nationwide's specific requirement.
You will see that they are only interested in entries in local authority searches relating to contamination. It is possible for there to be such an entry but in my experience this quite rare because most LAs haven't got round their area yet to survey it all and so have meaningless answers to the question about contamination on local searches. So unless there was an entry on the LA search about it, it wouldn't be necessary for the solr to tell Nationwide!
As a conveyancing solicitor I believe the information given in the post to be useful but I accept no liability except to fee-paying clientsRICHARD WEBSTER
As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.0 -
Hi Richard,
Thanks for that - that's useful to know.
Yes, the property is in England.
Perhaps I'll try to find out his email address and ping that over to him
- perhaps not, I don't want to irritate him even more.
Maybe I'll just ask our EA to ask him if he's read his CML handbook for Nationwide requirements!
This is bonkers, to know that we're being delayed by something that isn't even necessary.....
Whoever said moving is the second (or was it third) most stressful thing was right. Was it Maslow? (I knew that psychology A-level would come in handy one day).....0 -
Well, news this morning is that our buyers solicitor had the necessary info from her lender yesterday and that they're ready to exchange today!
Phoned my solicitor to let her know - and she's off sick today!! Great!
Apparently the only other person who can do the exchange is a partner who normally doesnt work in the afternoons!
I've asked if he can stay a little later to get this done, but have heard nothing back yet.....
Hmmm, maybe it'll be Monday now....
Am annoyed that our solicitors only has one other person who can do this stuff, who doesn't even work full days!
