why me

  hi, are all my cc companies and bank ganging up on me?
In all i have asked for 5 lots of statements from different banks and cc companies, in all 3 have replied, other two didn't even reply even after numerous letters, then the others after i requested that they pay me all the bank charges they have took off me, (sent recorded delivery) 14 days have come and gone and nothing. one even hasn't even been delivered or signed for after 13 days.
shall i start court proceedings on all of them? And try to guest what the other charges are?
i would like any advice that is going please.

Im presuming you sent the banks the Ist template letter? (SAR) if so they have 40 days to comply not 14, you could send them reminder letters before the 40 days are up but if they still fail to comply after 40 days thn you can report them to the ICO.
I wouldnt estimate any charges and if I were you I would read the bank reclaiming charges help thread as you need to follow due process along certain timescales before going anywhere near court

Andy it isnt just you going through this so dont take it so personally :)

The fact is that the banks and credit card companies are swamped with Subject Access Requests and cannot keep up. This isnt your problem though and you can file complaint to the Financial Commissioner at the delay in supplying your details.

Be patient, send your letters recorded delivery to the 2 outstanding companies advising you will be making complaints to the ICO. That is about all you can do for the moment but it may help speed things up a bit. Never ever estimate how much to reclaim. If you end up at court you need full evidence of the amount you are claiming to present at court.

With regard to the 3 companies you have started to reclaim from then just follow the next steps according to the timescales.

Reclaiming charges isnt always a quick process and even with the most compliant of companies it may have taken up to around 3 months from requesting details to actually being paid. Try to take a relaxed and methodical approach to it. Good luck :)

I think you are asking a lot of yourself, taking on 5 different banks at once!! I am sure you have read the tales of people here dealing with just one bank!

Might be an idea to concentrate and complete each stage on one or two banks at a time. Certainly, when it comes to court action, I would worry that you might get quite bogged down with all the preparation. It is very frustrating when you can't go any further forward without the info.

If that happens, you might be more likely to accept offers when you are entitled to more. Good luck, I know I couldn't do it!!
