Halifax Credit Card PPI Claim rejected

Hi All
I had a credit card with Halifax from 2004 - 2009 and is now all paid up. I contacted them to ask if I had ever paid PPI and they informed me I had so I asked them to make a claim as i was never aware i had it or was paying for it and if Id have known i had it i would of cancelled it.
Received a letter from them yesterday informing me that my claim was rejected on the following grounds:

-Prior to 2005 the sale of PPI was not regulated by the FSA. However we were members of teh General Insurance Standards Council which expected its memebers to act fairly and reasonably towards customers (?? surely if that was the case they wouldnt be paying out so much compensation?)

- Sale was made on a non-contact basis and as such, we were only required to provide you with info designed to ensure you could make an informed decision as to whether the policy met your personal requirements. It was ultimately your decision to purchase the policy.

- DOcs provided (in the post) provided both at point of sale and after purchasng PPI, fully explained benefits and limitations.

- Reviewed Info that we have you about the exclusions and limitation of policy and i have concluded they were explained to you sufficiently clearly and you were not affected by them.

Based on above evidence my conclusion is that the features of hte policy were adequately presented to you so that you could make an informed choice as to whether you wished to purchase the PPI policy.

Pretty standard letter to be honest and from looking at other forums it seems same wording is always used.

My problem is i never knew i had this policy and i am the sort of person who ALWAYS refuses insurance on top of things. In my line of work there is always temp work so paying my credit card back then would never have worried me, I literally would not pay for this if i knew it was something I'd agreed to. The forms you receive when you get a credit card are detailed and they ask you to sign in the box - which i did. It was my first credit card (no excuse i know) but i would NEVER had agreed to this policy and if id have known i had it i would have cancelled immediately.

SO........question is is it worth pursuing? Is it worth referring to FOS as I seriously think i was mis sold this product. I wanted a credit card not insurance.

    It would have appeared on each statement you paid it. So, that is around 60 statements potentially.

    A lot of what is paid out is people getting lucky with auto payouts, genuine provable reasons or bad audit trails.

    You have an unprovable allegation in saying you didnt know you had it despite having 5 years worth of statements. Your complaint is of the weakest type. Typically on these sorts of complaints you are either relying on getting lucky with auto payout or needing a stronger provable complaint reason.

    Based on their rejection letter which states that you took out the insurance on a "non-contact basis", your chances are very slim.

    You must have either filled in an application form or applied online without any bank staff being present. This means you mis-bought rather than were mis-sold.

    If you do still decide to refer your "complaint" to FOS, you can expect to wait around eighteen months for the Ombudsman to side with the Bank in these circumstances.

    As the bank has already rejected the complaint, I think an auto payout is out of the question now.

    I can't see how you can say that you weren't aware of it.

    Your'e chances are slim to none I'm afraid.

    Not if the credit card balance was nil of course. In this scenario, though, the OP wouldn't have paid any PPI.
