Council tax and lodgers

The law is clear that a resident owner/landlord is always liable for the council tax due on a property (section 6 of the local government finance act 1992) so your in the clear.

Even if the landlord/owner wasn't resident the property would have been a HMO which would make the landlord liable anyway (council tax (liability for owners) regulations 1992.

In respect of the other lodger it sounds like he lives in the house whilst he works and then returns home at weekends so if he had been the only other occupier with the landlord then a 25% discount would still have applied.

I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
