Duplicate Order

Hi I hope someone can advise me please?
I ordered a 7" tablet on Ebay for Hubby for Christmas, it stated it was in Swansea UK. A couple of days later I received a call from FEDEX, they wanted me to confirm the cost of the parcel to which I did. It did not match what the seller had put on the customs form which said $15 ie about £9 which of course was way out!! FEDEX refused to carry the parcel. I contacted the seller and they said they would send another out with DHL I agreed. I then had a note back to say they were going to wait until FEDEX returned the original but I did not agree and asked them to ship the replacement out straight away as I had waited long enough with the messed up delivery coming from CHINA!!! Not Swansea, the seller claimed this was due to them running out of stock here in the uk!
I recieved my parcel from DHL a few days later I opened it up and the tablet was wrapped up in all the shipping bags/labels for FEDEX so I guess they waited and sent out the original. Last week DHL arrived with a parcel for me I signed for it as I did with the first and it was yet another tablet.
The seller has not contacted me regarding the duplicate order, so what are my rights/obligations for this? How long do I have to wait for them to contact me / return the goods? Thanks in advance Piglet

Why are you waiting for them to contact you?0 -
They can pursue you for up to 6 years.
Do the right thing and contact them about it.
How would you feel if they kept your money and not sent you anything?Thinking critically since 1996....0 -
Like most people my advice is you should contact them ASAP and inform them about their mistake.
There again there is the real world and not everybody follows their own advice.I think the surest sign that intelligent life exists elsewhere in the universe is that none of it has tried to contact us.0 -
Hi thanks for your replies, I was told by a friend to wait for them to contact me. I do feel that the company were not totally honest in the first place stating their items are in the UK when they are actually in China they are still selling the items stated they in the UK! I will take your advice and contact them to let them know what has happened.0

You can wait for them to contact you if you wish, but the point is the goods aren't yours and you will have an obligation to reasonably allow them to collect the goods. The point of contacting them straight away is to prevent problems further down the line.
Since they are in China, have them send you money to cover the costs, a pre-payment label or for them to book the courier. Don't send it back in the hope they'll reimburse your costs.0 -
I have just contacted Carphone Warehouse to inform them of a duplicate order I have received for a Kindle Fire HD and case.
Clearing up the debacle took the best part of my entire lunchbreak at work, and now I'll be taking the trouble to drop the duplicated order off to my local branch during my lunchbreak tomorrow (which is apparently less hassle than asking CPW to arrange a courier collection).
This is the second time I have received more than I had ordered (last time Tesco sent me a more expensive Kindle Fire HD when I ordered a Kindle Paperwhite, and it was a complete pain in the backside to return the mistaken item and obtain my originally ordered item).
I agree that an administrative mistake on the part of a company doesn't entitle the recipient to retain a duplicated order, but it irks me that the entirely innocent party (aka the recipient) must be in any way inconvenienced in terms of time/postage money/personal travel/phone credit to flag up and rectify the sender's mistake.
In fact, I feel that these small 'goodwill' gestures that some stores offer in return for customer honesty and the hassle we end up going to in order to put things right ought to be a standard response to these situations.
You hear a lot of people deploring the immorality/illegality of folks' mindsets out there who are tempted to leave such mistakes uncorrected for their own gain, but I have personally had to investigate and then chase up owed Payment Protection Insurance money for a mis-sold policy that my bank had no intention of willingly declaring and voluntarily refunding to me.
It is clear that we are living in a society where honesty and integrity are something that many organisations are happy to forego if the end result boosts profits and bolsters individual bonus payouts.
From what the customer services woman was telling me on the phone, the duplicate order I have flagged up was despatched on exactly the same paperwork as the original order (so it is extremely unlikely they would have ever noticed a stock discrepancy in relation to my order).
In fact, my honesty might well have ended up invalidating the warranty on my original purchase as they will now have to 'fiddle' the paperwork and produce a 'phantom' order to account for the inexplicable appearance of the second item that my call to them has now introduced, because my returning of the duplicate item might have been linked up to my original order and they would have no longer have any record of me retaining possession of the original order items.
Luckily for me, they spotted this, or I would actually be left WORSE off for bringing this to their attention!
Being dishonest might come back to haunt you, but being honest can be an utter pain too! :-(0 -
In this case I'd keep hold of the duplicate item as this sounds like a cheap Chinese knock off and I'd expect it to break at any time. One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
