conservatory and neighbour issues.

we are mid terrace, neighbour has an extension already which now forms the boundry line.
wanted a conservatory, spoke to them about it, employed a company to make it, put in planning, spoke to them to ask if we could build off of their wall.
planning was granted, asked them if they have made a decision, gave them the surveyors number so any Qs could be answered etc.
told them work was due to start, and again asked permissiion.
have been ignored.
we started building footings for the sides not attaching to them and breaking up out patio. they complained about the noise. ( it was all dug by hand)
ive spoken to them today, they dont want us to build off of them, ( annoying but fine) but they also dont want us to dig any foundations out near their existing extension.
what the hell do i do now!??

  • um, if i'm not mistaken they can say what they like but if its your property you can dig the foundations.....

why not build a wall directly touching there wall. don't see how they can stop that, you'd only be building up the boundary just as they have done.

oh and i imagine they must've created quite a bit of noise whilst their extension was being built? some people!

If they have built a brick wall on boundry line? you will find that they have laid foundations into your property. They should have asked permission!
You are entitled to dig down on your land and lay foundations for your building, butt up the concrete next to theirs.
Build your wall as tight to theirs as poss.
Does their gutters intrude onto your property?
Could be a problem for your gutters as well?

I think you should read this booklet and see if any applies
