Help please! Bank not sent all 6 yrs statements!

Hi everyone, I would really appreciate it if someone knows what I can do next. My bank LloydsTSB has only sent me statements going back to 2003 on both of my accounts with them, I know that I probably need to write off to them requesting more statements, but I was wondering if there is another template letter that I could use to help me with this. (Also do I give them a time limit in sending my statements?)

a) Did you request the 6 years to start with ?
b) Has the 40-day period elapsed ?
Give them a call tomorrow. You shouldn't need to use another template letter as it covers everything. Depending on your answer to the questions above will determine your next move, but you may need to inform the Information Commissioner.0 -

Thankyou for your reply, so quick! I used the original template letter requesting all 6 years statements, giving them 40 days time limit. The letter LloydsTSB sent me back yesterday states:
"You may now wish to proceed with your claim for reimbursement of charges but, if you do feel you need further statements, this will take longer to access our archived data. Please let me know by returning this letter in the attached pre-paid envelope and I will order them for you. Under the terms of the Data Protection Act, we are allowed up to 40 days to fulfil your request."
Does that mean that the bank is entitled to another 40 days from their reply on 17/04/2007? And is there a template letter that I can use? Should I phone my local branch?Or should I make a complaint to the information commissioner? I have downloaded The Data Protection Act 1988 Complaint form from the Information Commissioners Office, should I just fill it in and send it off? Thankyou again for all your help, Claire.0 -
Hmm, I'm not sure about this one. If you originally requested the 6 years worth of information within 40 days in the first letter. They should have provided it.
They are getting you to submit a new request for the other 3 years which means they have another 40 days. Obviously stalling for time ! Why say "if you need further statements", when that's what you asked for in the first place !!
I'm not sure of the legalities but I would argue that they are in breach of the first letter you sent which CLEARLY requested the required information within the stated timescales. So Claire, I would stick with that and inform them that they are in breach of the DPA, give them another 7 days to deliver the goods then inform the Information Commissioner.

You're welcome Claire. Just don't submit a new request to them. Use the dates from your original letter to advise them they are in breach of the DPA.:)0

Fire off this letter by Rex_Mundi with their letter but score out the bit about 40 days in their letter.

Hi Claire
My 40 days are due up with Lloyds this week and I haven't heard a thing. I've been on line and added the charges up myself. I'm a year missing (2001), my charges to date for my 2 accounts is £6K, so I've sent the letter off asking for my refund anyway - they have 7 days left to respond!Mel :heartpuls0
