Blue badge parking fine

My friend parked her car in a public car park this morning at 10.30am and returned at 12.05pm. We couldn't fine a free disabled bay so parked as near to them as possible. I put my new-type blue badge on the dashboard with the badge number, issuer and time showing and when we returned my friend had a parking ticket. What I didn't realise at the time is that I should also have shown the removable badge part. Should I/she be liable to pay the fine? If so I'd pay of course, it's hardly her mistake, I'm just looking for peoples opinions.

  • Need to know if it's a council Penalty Charge Notice, or a private company pretending to do much the same. Who issues the ticket? Who is the payment to? Only then can the appropriate advice be given.

    Thank you for your reply. It's not a private company, it was issued by the local authority-employed parking attendant, payable to the local council. My friend has just told me she's queried it and is waiting for a reply.

    She 'should' be let off by the Council if it was a genuine mistake and this was the first time she's got a PCN. Many Councils will allow one Blue Badge 'mistake'.

    But if they do not cancel the PCN she should not just rush to pay it just because they will dangle the carrot of the discount (bargain...not!!). She/you should start a new thread on pepipoo forums for help, in fact you could do so now - but not without pics of both sides of the PCN:

    Even if you do not start a thread there yet, then at least read some Blue Badge cases on the first few pages to see the sort of detail needed, advice given and successes chalked up.

    By the way - as you are here - can I just tell you and your friend that if ever you get a private fake PCN (Parking Charge Notice) then ignore it = SCAM.

    Thank you for your advice coupon mad, I'm seeing my friend tomorrow and will get the pics. Meanwhile I'll have a look at the pepipoo forums.

    Re PCN's I got one three years ago when I had to stop at a motorway servie area suffering norovirus on a long distance journey, I did ignore it and the company eventually left me alone.

    Sounds like I make a habit of trying to get out of paying fines, I really don't!

    Mrs annoyingly had one of these from Mablethorpe council. She doesn't have a time clock being based in Scotland but they did her for it anyway, despite disabled users being allowed to park for up to two hours and us only being there for an hour after the car park officially opened (even by the time on the ticket).

    Computer said no and we haven't been back since. Anyways, good luck, the point of the story is, you have technically commited the offence, you just hve to hope, as Coupon-Mad said, that the council in question is a bit less of a pain than Mablethorpe!

    Did you pay the fine or appeal it to the adjudicator?

    My friend had a letter asking for photocopy of my blue badge and trying to barter, lowering the fine. Bad move on their part. I suggested she sent the photocopy with a covering letter telling them to deal with me as the badge is relevant to the holder, not the car. A letter arrived today confirming that the charge has been waived.

    Admittedly my friend was very sceptical when I told her we won't be paying, but I pointed her in the direction of MSE. She's hooked! :)
