Problems claiming on car Warranty

Hi, I bought a second hand car which came with a 6 month warranty provided by a warranty company not the garage which I bought the car from. Within those 6 months the clutch went and when trying to claim an asessor came from the company to look at the car, they then said that the claim was invalid due to misuse. My husband is a mechanic and did not agree with this, we therefore paid an independent assessor to assess the case. They wrote a lengthy report explaining that the claim is valid which we forwarded to the claim company. I have just recieved a letter from the warranty company saying that they are not going to pay for it. Is there anything else I can do?

  • The clutch is a wear and tear item. What has failed and why have they said it is misuse?

Warranty rarely covers anything useful and loopholes get them out of most other claims....., Good luck!

It's the flywheel that has gone and I have no idea why they say it is misuse

Its standard response for clutch faults, "you must have been riding the clutch".

Dual mass flywheel? Diesel? That's a £1000+ bill right away. That's why they're squirming out of it.

DMF and DPF, the two reasons why 2nd hand diesels are not worth buying.

I take it assessor removed the gearbox to expose the clutch to enable him to make his report? If he is saying it is a failure rather than wear and tear and providing the car has been owned for less than 6 months, it could be the dealer you should be pursuing.

Cane we have more info on the car like make/model/age/mileage please.

DMF (Dual Mass Flywheel) They wear out like a clutch so now a wear and tear item.

Why do they say abuse and not just wear and tear? I would push them on that. But as you bought from a dealer. Then tell them they will be fixing it and you will help them recover the costs from the warranty company.
