aiiiance and leicester, charges for not useing account

I opened a accurent account, with the a/l and while there, they got me to open a savers account, not telling me that if i did not pay in any money, they would charge, me £5 penlty,a month.Any way i never used any of the accounts, i had £114 in the current account but now a year later they say, they have taken that ,and i still owe them £23 as im over drawn, £130 in charges for not useing my savers account. So i have just lost £114 of my money, and stillowe them £23 and they will not close the account untill i pay the £23, is this fare.
