Put your complaint in writing. Keep it simple and keep to the facts. Stay away from emotional phrases (such as being upset, disappointed, angry etc). You ordered 26 of x for a total price of x. On x date, you received a delivery for 13 stating the further 13 would be delivered at a later time/date. That delivery never arrived, you have contacted them to inform them of this, they provided a "delivery" reference of xxxxxxx which corresponds to the first box which was the only box in its consignment. They are unable to provide any reference for the 2nd half of the shipment.
You are therefore requesting that they either send the remaining items or issue a refund for the goods not received. Entitle it "letter before action" and give them a 14 day deadline (in the letter) to respond.
Unless the seller can provide a reference for the 2nd part.......tbh I dont think its going to count against the OP. I mean its common for people to buy things in advance and only realise something is wrong when they actually go to use/open it. Remember under SoGA you have a "reasonable time" to inspect the goods to see whether they conform to contract. The purpose they were bought for can be taken into consideration when deciding what is a reasonable time.
If someone bought winter gear in summer, that reasonable time may be extended to winter due to the nature of the goods.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
