Can the loan be written off ?

My girlfriend recently made a complaint to her loan company as they had charged more money than they were due to take and also charged for letters and phone calls, all of which should never have happened. This is about the 4th time they have done this this year and it has happened many other times over the years. In the response that the company sent back they said that they had received a payment from her earlier this year for just over £10,000 and even went as far to specify the date that this was sent on. The strange thing is that this figure was not £10,000 as it was just over £3,000 that was paid. If it had been £10,000 then the loan would have been paid off as at that point the balance was approx £7,000.

Is there anything legally that would allow this loan to be written off as the company have "confirmed" that over £10,000 was paid so therefore more than the balance of the account ? I understand that some people will come back and say this is morally wrong however this company is making our lives hell and anything we can do to get rid of it we would try.

    They will not have to "write off" a loan on the basis of what appears to be a typing error.
  • Had they mistyped it as £100 would you expect them not have to knock off the correct balance? Facetious yes, but the point still stands.

    They do not have to write-off a huge debt due to a simple typing error in a letter.

    Go back to the drawing board and come back with a more ideal reason for the loan to be written off.

    Its a typing error.

    In another part of the letter there is a reference to another payment of approx £1000 on a specified date that never took place. I take it there is no way that this can be used either as a confirmation of payment ?

  • No, it doesn't really matter what was said on any of the letters. What matters is the actual transactions that take place.

    You financial position bears no relationship to whether a loan is repayable or not.

    If a payment was made for this amount on that date then this would be a good confirmation that they received it.
    If a payment wasn't made for this amount on that date then the letter was wrong.

    Then complain about what they are doing that is making your lives hell. If they keep sending out incorrect information then complain about that. Ask for a goodwill gesture to cover your inconvenience for dealing with the incorrect information.
    If they are chasing you for money that you honestly don't owe then complain about that. If they carry on, take it to the ombudsman.
    Don't let them get away with making your lives hell. But they should be punished for making your lives hell, not for a simple error.

    Search for the harassment letter on these boards..And send it to them.
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    So now we have the truth. You are in financial difficulty and are desperately trying to find a way out of your obligations.

    I'm afraid that you will, like the rest of us, have to use the usual methods of paying off your debts.

    How do you know what _Andy_'s financial situation is ?

    To stop the company making your lives hell, pay them what you owe, it's quite simple really.
