Due to a virus that has taken away my balance system in Sep 2010 whist diving i havent been able to work ! My employers at the time sent me to see a specialist ex naval Dr, specialising in Diving accidents (Jan 2011) who wrote to them confirming i was in no fit state to do any sort of work as did my 2 private consultants ( I had private health ins) on the recommendation of the ex naval Dr my employment was terminated as i couldnt work due to the disability he noted that health and safety would be an issue and also my own personal well being would be compromised doing any sort of work ! ( they had held my position open for 18 months so fair i guess ) The following day i went to an ESA medical who found me fit to work !
I appealed this decision and have now had my appeal date (Jan 2013)
I have lost my private health as this went with my job and i have a letter from my last consultant saying i have deteriorated since my physio stopped. I spoke to my GP on friday who said they will do a letter on my behalf stating the criteria of thing i cant do which the nurse at the original ESA examination said i could even though i couldnt !
Dial the charity are also helping me with my case however any advice before the appeal would be great !
the appeal is based on the fact i cant walk for more then 10 metres without becoming disoriented liable to fall, i then become extremely fatigued doing any sort of physical activity as my brain still tries to make my inner ear balance work even though the right ear is now redundant ! i have letters from 2 Drs and one professor of balance (only 2 in Europe) explaining that certain thing increase the problem including open spaces, artificial lighting, sudden movement, causing extreme dizzyness and nausea (to the point i am sick) and extreme fatigue and as my brain is overworked some days i will sleep for 16 to 18 hours even with all this they still deemed me fit to work !
Advice please
Thanks

The ESA test is for mobility not just walking, which includes your ability to propel a manual wheelchair, irrelevant of whether you use one or even own one.
Unless you can show that you can not do this or that it is not reasonable for you to use a wheelchair, then you will not score points for this descriptor.0 -
how can i use a wheelchair when movement of around 10 metres makes me disorientated and sick . my day to day life has me sitting upright in a chair any sudden movement creates dizziness which includes watching tv ,i would be unable to propel a wheelchair this would bring on severe fatigue even typing this brings on nausea ! ! !Cpt.Scarlet wrote: »The ESA test is for mobility not just walking, which includes your ability to propel a manual wheelchair, irrelevant of whether you use one or even own one.

Then you need to include this information in your submission to the Tribunal, you can't assume they will figure this out for themselves, especially if you have only provided evidence in relation to walking, how can i use a wheelchair when movement of around 10 metres makes me disorientated and sick . my day to day life has me sitting upright in a chair any sudden movement creates dizziness which includes watching tv ,i would be unable to propel a wheelchair this would bring on severe fatigue even typing this brings on nausea ! ! !0 -
Less than one month ago, you were able to visit a store [#108 ] on many occasions over a eight week period. Now only a month later you can't move 10 meters or even watch the TV without becoming disorientated and sick, that's a terrible acceleration in your mobility needs my friend. You should, in addition to the appeal seek an immediate medical re-assessment of your condition to see if they can arrest or slow down that 'rocket-like' rate of decline.Disclaimer : Everything I write on this forum is my opinion. I try to be an even-handed poster and accept that you at times may not agree with these opinions or how I choose to express them, this is not my problem. Richie as per my previous post the condition i have is variable 5 days out of 7 i can be ill the other 2 days i can be fine part of my physio to overcome this was to go to a supermarket most people with an inner ear problem balance suffer in supermarkets because of the high aisles and bright colours and crowds hence why i visit at night when the store is empty it is peripheral vision training and also a good time to aquire my food cheap. As my post also states my condition has deteriorated since my private health insurance cancelled so please find the facts about people conditions before making assumptions0 -

- if you 'could' a month ago and 'can't' do 10 metres now
- you may need more than physio intervention
deteriorated since my private health insurance cancelled
If your health has """deteriorated since your private health insurance cancelled""" there may me other sub-sets of your medical condition or symptoms that you might benefit from being reconsidered by your clinician. The evidence from which might well benefit you for your appeal.Disclaimer : Everything I write on this forum is my opinion. They already have a letter from my consultant that says that since my private physio has stopped my condition has rapidly deteriorated, the Nhs don.t offer physio for my condition.Apart from the peripheral vision excercises i can do on good days the shopping trip is to give me spacial awareness on the days i feel i am up to it
Tesco are also fully aware of my condition as the night manger has helped both me and my carer in the store0 -
