Halifax PPI Help - 2 refusal letters

Halifax state that my husband has not been missold as it was before the FSO was in charge so regulations were different. The amount which would be returned is trivial but this is principle. Refused on basis that a box was ticked and that it was not missold (standard letter by reading other posts) I replied to this stating that they appear to have recognised the PPI is still running and even if they believe it has not been misold why have they been taking it since they were informed that my husband is self-employed.
The 2nd letter states the points which we made in regards to the sale of the PPI but offers no argument, just stating that they still believe it wasn't missold, and to telephone to cancel the PPI that is still running - there is no way my husband will be able to make that phonecall without loosing his rag. If we aren't happy with the decision we can write back or contact the FSO (as they know it was taken out before they took over). Just not sure best way to go, feeling patronised and extremley stupid on this one.

The FOS have never been in charge. That is not their role. Insurance became regulated by the FSA in January 2005 and from that point the FOS becomes available if you disagree with their response. If this is Halifax (as in the bank or building society as it used to be) then they have to consider pre-regulation complaints. Most PPI does cover the self employed. Self employment is only an issue where the PPI does not cover it or the terms are too onerous to make a claim.there is no way my husband will be able to make that phonecall without loosing his rag.
That is a bit worrying for such a basic transaction request. However, that is not Halifax's fault and something your husband needs to address personally.If we aren't happy with the decision we can write back or contact the FSO (as they know it was taken out before they took over).
If the case is within the remit of the FOS then you can refer it to the FOS. The letter from Halifax will verify if you have the right to refer it to the FOS. Halifax have made their decision. Unless you have evidence that will change their mind, there is no point writing back to them. Perhaps before you go back to the FOS, you should check if self employed are covered on the Halifax PPI. If they are then you will know that your complaint doesnt have much merit. If self employed is not covered then you have a very strong case.I am an Independent Financial Adviser (IFA).
