  • Using the bag for 2 days is accepting the goods. The bag was being used by the poster for the purpose it was bought. They were not examing or testing the product they were just using it

    Using that logic, I could buy a car, TV or anything else for that matter and if it failed 2 days after buying it, I would not be entitled to reject it due to the fact that I was using it for the purpose it was sold.
    When would you say that they have accepted the goods then?

    After they have had a reasonable time to check that it was suitable for the purpose that it was sold for, which in my opinion, would be a few days at least.

    There is no legal definition of what is considered to be a reasonable time, but this is how the OFT state it
    The law does not give a time limit for acceptance. When trying to decide if a customer has had a reasonable opportunity to inspect their goods, consider what an impartial person in a court would think reasonable for that product in the circumstances.

    And Trading Standards don't seem to think that 2 days is unreasonable.
    For example, if you bought a watch and it stopped working after a couple of days, you should explain the problem to the trader and seek a refund. The trader may want to examine the watch. You should also produce your proof of purchase if it is requested.

    A watch is a different situation to a bag. With a watch you can't examine the internal workings of the watch so need to have it for a period of time to properly see whether its acceptable.

    A bag is something that can be examined and tested in a matter of minutes.

    Anyway it sounds like we are only out by a matter of a couple of days. I think 2 days is reasonable to check and accept a bag, you think "a few days is reasonable".

    Despite you being deliberately vague in your "timeframe", I don't believe there is a massive difference in our timescales!

    Never expect a shop worker to give you their full name. This would allow you to find them on facebook, look their address up in the phonebook and countless other infringements on their privacy. My OH gets this a lot, to which he always says, I'm the only X in my shop, so if you want to complain, they'll know who you're talking about.

    The guy is just enforcing company policy, as is his job. It's not his fault, he shouldn't have to hand over his personal details for that.
