You can't do ANYTHING until they're at least 2 full months behind with their rent. Are they?

Not true. For a section 8 using grounds 10 and 11 there is no minimum amount of arrears.

Hi. You need to download form RQ from the Land Registry, complete it and send it in today. That makes it much harder for the tenants to defraud you out of your property. It takes 5 minutes to fill in, costs nothing, and all of the information required for the form is easily to hand.

I'd also check that there have been no transactions/enquiries on the Land Registry in the last 3 months, but that may be a little harder.

The following FAQ explains a bit more with regards protecting your property from fraud, including the form RQ GDB2222 refers to.

As far as checking whether any transactions/enquiries have taken place it might be helpful to consider the following

The land register is open to public inspection both online and by post.

IF you are concerned that you have been a victim of property fraud then the first thing to do is to check the land register yourself - if it reveals the details as originally registered then the form RQ may be worth considering.

If you remain concerned then Contact Us but following the online guidance is the key initially

No reliance should be placed on the above! Absolutely none, do you hear?

Hi LR rep. Isn't it a bit late to take action if there are already changes that have been made to the register? I know there are various LR guarantees, but you can see where I am coming from. If fraud is suspected, it is useful to know if the LR has furnished any info at all about the property, so as to prevent the fraudulent transaction going through, if possible. I am a bit behind the times, but the OP might be interested to know whether his property's details have been downloaded or an office copy issued - that sort of thing. What should he do about that?

It's quite difficult to help you if you haven't answered people's questions.

    1. Have you protected their deposit, regardless of how much it was?
    (if not, do it immediately!)
    Too late now.

If deposit is not registered within 30 days, IT MUST BE RETURNED. Late registration is no longer an option since April 2012 (Localism Act).

GDB2222 - you are of course quite right but I was simply responding to your referral to form RQ and the process to be followed if appropriate.

The background to the OP's situation implied that the ID theft related to the ordering of goods and the non-payment of rent. Whilst the risk of property fraud exists I took your quite correct mention of form RQ to be a precautionary next step in case the ID theft as mentioned snowballed into something more re the property itself. Ensuring that their address for service is up-to-date and includes more than one address is also a prudent next step.

The poster can make a request under FOI for information relating to any applications having been submitted for official copies if they wish. However if the title remains unaltered then following the advice provided online, including form RQ, would be our recommendation. They are aware that the tenant has already used their name/address so taking the necessary steps to minimalise the risk of any further fraud seems to be a logical next step

  • Definitely contact CIFAS (as suggested earlier), at least they won't be able to get anything else in your name again.
