Hi im a landlord of a house, theyveonly been in the house 2-3 months. They have been terrible tenants so far, 1st not paying the full rent 2nd not paying the full deposit and the 3rd and worst he has ordered items with 2 companies on my name(ID THEFT). It came to my attention when I checked my credit report, 2 companies which iv never bought from and DOB which is not mine. Companies have confirmed it’s the tenant.
My question is they don’t want to leave, they’ve said they’ll pay the money fr rent/depost. But they’ve ordered items under my name which im displeased about. I need some advice. it is for a shorthold agreement which Is 6 months by default. But some one has mentioned section 8. if anyone can advise much appreciated Thanks

Get rid at the end of the 6 months and start again but be aware that they may not leave when they should and they may trash the place but personally I wouldn't trust them with a barge pole.
Other people will explain what you need to do to start the processDon't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
You have reported THEFT to Police & got crime reference number?? If not, do so.
Issues S8 for late rent (not mandatory eviction, but worth a try..)
Re. deposit, even of only paid 50p, have you protected it?? If not any S21 will be invalid: You might have to return deposit before S21 in that case...
What were the results of reference & credit checks??
Re. identity theft, how do you KNOW FOR SURE it was tenants not, say your ex-wife or a neighbour...???

Hope Land registry have multiple addresses for your property, not just the house itself, or by now they could have raised a mortgage on it & flogged it to some other mug: Mind you if they did that they'd have disappeared....

Do it all but, in particular, INFORM THE POLICE and get a crime reference number...

Whats the point? to provide a paper trail that will protect you if things get worse obviously? if for some reason this ends up in court you can show the judge evidence of their dishonest nature which is only going to help you evict them.
All this begs the question if the tenant cant get credit what the hell were your credit checks and references because its clear YOU have failed to do your due diligence in protecting your asset!When using the housing forum please use the sticky threads for valuable information.0 -
Hi. You need to download form RQ from the Land Registry, complete it and send it in today. That makes it much harder for the tenants to defraud you out of your property. It takes 5 minutes to fill in, costs nothing, and all of the information required for the form is easily to hand.
I'd also check that there have been no transactions/enquiries on the Land Registry in the last 3 months, but that may be a little harder.No reliance should be placed on the above! Absolutely none, do you hear?0 -
WHY did you not take the full deposit before graning the tenancy?
WHY did nothing adverse show up when you credit checked the tenants before granting the tenancy? (you DID credit check, yes?)
HAVE you reported to police? Why not? You want to evict? You need evidence!
HAVE you issued a S8 Notice? (Police report will help with this)
HAVE you issued a S21 Notice (only valid if the deposit is registered)?
If deposit is not registered, RETURN it to the tenants at once!

It's quite difficult to help you if you haven't answered people's questions.
1. Have you protected their deposit, regardless of how much it was?
(if not, do it immediately!)
2. How much of their rent have they paid?
You can't do ANYTHING until they're at least 2 full months behind with their rent. Are they?
Also, there is no point moaning about ID theft until you report it to the police!Should've = Should HAVE (not 'of')
