Charges on Property

If a person has a legal charge (based on a % of the net proceeds of sale) on a property but their name no longer appears on the title deeds, does he/she need to agree before the property can be sold?

    So who put the charge on?
  • It was a District Judge as part of a divorce settlement. The legal agreement was that my name was removed from the title deeds but that my name is entered as a registered charge on the property based upon a % of the net proceeds when it is sold. After 16 years it has now been put on the market but I have not been consulted about the price the property is advertised for and presumably I won't be consulted on what it is sold for (even though my share will depend on the actual sale price). Is there anyway I can stop the sale if I think it is being sold too cheaply?
