county council sucks - pot hole dispute!!

Mid august I hit a pothole, lost my front tyre. Car had just had two new tyres fitted 3 weeks earlier £130/tyre. I called the council the next day to report the problem but was smart enough to get photos of the failed road surface the same day, with a measuring tape etc.

Next day the road had been filled! Well done the council. 4 months after filing my well recorded turn of events I get a letter telling me the council inspect this road 4 times/year. Last inspection was beg may and as their records reflect a duty of care I can ram my claim where the sun doesn't shine.

I'm thinking if their inspection system is so hot then why did they rush out to fill the very next day? I don't accept the councils position on this. The road surface was dire and there is no way the damage happened in 3 months, impossible!! Th whole side of the road from the white line, which had all but gone, to the edge of the grass verge had disappeared! Advice anyone??

    Good on the council for fixing it asap.

    If they didn't know it was defective why do you expect them to pay?

    Potholes can and do occur overnight, as anyone who's been out in the recent bad weather can testify. If it can be proven that they regularly inspect every 3 months than I'd say that is pretty reasonable. Can you prove the council knew about the pothole beforehand and took no reasonable steps to fix it?
  • Thanks Dave, the pothole web site link is reall helpful. I've requested further information on inspections carried out on the road. When I get this from the council I should be able to check to verify the last inspection date and road condition. I'll take it from there.
