what to do when son turns 16?

Had home visit from dla,was very quick,no problems about me being sons appointee.
Now, when lady was here she told me that was my sons money side of things sorted and had i looked into what we were going to do once he turned 16 and she mentioned adults with incapacities act(we live in Scotland).She wasnt sure about it but said i should look into it.
We had looked into power of attorney but my son is incapable of making any decisions for himself so we knew we couldnt apply for that.
Have googled and read up about the act but am unsure what im supposed to be applying for(guardianship?although we are his parents so dont understand why it would be that).
So in short, how do i make sure that it is still myself and hubby that can make decisions for our son and how do i go about it?

You need to apply for guardianship to ensure you have essentially the same power to make decisions as he would.
At the moment, you have only the same legal powers as any other 16 year olds parents.
The doctors may take your views into consideration, but they do not have to agree to your wishes or demands, even where there may be significant consequences of the decision.
In the worst case, this can for example cause medical treatment against your will, or him being taken into care, when you believe you can cope.0 -
Thanks for replying.So it is guardianship we are applying for then,after reading that im still confused as to how we go about it.Do we go and see a lawyer and can myself,OH and eldest son(19)all be named?would like to have my eldest boys name on it in case anything happens to us(he is more than willing to be named and is more than capable of deciding whats best for his brother if need be).

there should be a carers centre near you somewhere
carers scotland has an adviceline 0808 808 7777

they can advise
and maybe give more practical help as well (tell you what you need to do next etc)0 -
Found a step by step guide online,all very confusing.Will contact the carers advice line as wolfehouse suggested or maybe contact social work for advice.
