Direct Debit Taken Incorrectly

I had a policy to cover the CH, plumbing, electrics, drainage etc with Corgi HomePlan Plus.
I gave them notice on 23 Oct 2012 that I was moving home on 5 Nov 2012. But they said they could not take advance notice to close the policy I must call back on 1 Nov. Unfortunatley I could not call back on that date, and then with the stress of the move (I was moving abroad)...I forgot.
They have now taken another DD from my acount for December and refuse to return it.
They acknowledge my call of 23 Oct - it is on their database. But they say "it is not their policy to take advance notice to cancel a contract".
What are my rights here?
They are the only supplier of many that I cancelled due to moving house that have taken this stance.
Many thanks for any advice..

Welcome to MSE Russ.
Quite a tricky one really as they told you they could not cancel in advance and that you should call back to cancel. You failed to do so which has resulted in them taking the DD. These things can often be cancelled by you cancelling the DD with your bank (rather than via the company) so that was also an option.
I fail to see any fault on behalf of the company (aside from their ineffectual systems) but it seemed to be your fault that you forgot to cancel so it does seem reasonable for them to charge for a service they are (were) providing.
Not really sure you have a leg to stand on really. Sorry!Thinking critically since 1996....0 -
Contact your bank and ask them to return it under the Direct Debit Guarantee.
Also get your bank to cancel the DD @ their side. TBH, that is all you needed to do, after telling them of your wish to cancel.it is not their policy to take advance notice to cancel a contract
I would say that is highly unfair.. Wonder if they also have a 30 day cancelation period....Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
I am not convinced it is unfair. What do you base it on? It's not to the detriment of the customer.Thinking critically since 1996....0

You gave them 12 days notice... hardly 'advanced notice'. Often policies insist on 1 month notice.
What does their cancellation policy say?0
