Can I get out of my tenancy?

Hi,

Il just outline the facts first. I am 3 months into a 6 month fixed tenancy, with a private landlord. I live in a building with 6 other flats, all owned by the same LL. We were told by the person that showed us the flat (some sort of cleaner that works for the ladlord) that it was very quiet, perfect for families and everyone in the building was a professional.

Basically I have moved in with my wife who is 7 months pregnant and about a month after we moved in the person above us had a party and had loud thumping music on until 5am. We spoke to him and he said itd be a one off and he would let us know if he had any other parties. Thats fair enough, but he does keep playing music loud enough to hear in my flat, so we are already annoyed at this.

The real problems began when we noticed police coming in and out of the building a few times a week. We asked them why and they said this was nothing to worry about, but we have found out from a friend who is in the police that one of the people above us is a convicted drug dealer and they regularly check on him.

Is this grounds for us to get out of our tenancy? This is not a place I want my child to live and I feel like we have been completely deceived.

    No, you can't.

    1) keep asking your neighbour to keep the noise down, if he was fairly decent when you spoke to him then he prob doesn't realise that you can hear it.

    2) police coming to check up on a "convicted drug dealer" a few of times a week? why? i'm sure thye have better things to do and the "ex con" could tell them to get lost.
    something doesnt add up here. and your "friend in the police" shouldn't be disclosing such info, it would be more than his jobs worth. i suspect him, or you, is bending the truth here.
  • Im not bending the truth, we even heard the police officer ask the tenant above "are you staying away from drugs?" so all they did was confirm our suspicions. Im not sure why they would but on thee occasions a police officer has entered the building with a letter and gone up to the flat in question. They probably shouldnt have told us this but they are close freinds.

    You can't get out of contract because someone is playing music inthe flat above you. Is it particularly loud or do you have poor soundproofing or a very low tolerance level? Does it go on to particualy late at night?
    To be honest with 3months left you probably just need to wait out the 3 months unless you can get agreement from the landlord to let you go early (although not sure why they wouldagree but they might).
    Not too sure why the police are coming anf going. A bit strange but if they arenot in your flat /having loud raids then not sure it should affect you too much. Are they using it asa stakehouse or something? All sounds a bit weird -can you ask the police if there are any problems youshould know about/and areyou at risk? If they can't /won't say then just tryand ignore it Iguess.

    You can get out of your tenancy agreement early IF the landlord agrees. Try asking. You may need to persuade him eg by offering to pay his associated costs.
